Terms of Service
This is a draft. Selby’s lawyer reviews it before launch.
Version 2026-10-draft
Who can use Selby
You must be 18 or older and in the United States, and use one account of your own.
Your account
Give accurate details, and keep your sign-in to yourself. You’re responsible for what’s done with your account.
What Selby is
Selby is a marketplace where members sell to each other. Selby isn’t the seller of what’s listed, and doesn’t own, inspect or ship it.
When you sell, you appoint Selby as your agent to receive payment for you. When you buy, you pay Selby, and Selby receives your payment as the seller’s agent: once you’ve paid Selby, you’ve paid the seller. Selby then pays the seller through Stripe, as these terms and Selby’s payout schedule say.
[For Selby’s lawyer: Stripe’s required clause about the Stripe Connected Account Agreement, as Stripe words it.]
Fees
Selby’s fees are on the fees page. Buyer Protection is included in the price a buyer sees; the seller’s fee comes out of the sale.
Selling
- List only what you have, describe it truthfully, and follow the prohibited items policy.
- Selby checks listings, limits how much a seller can list at first, and may ask you to verify your ID. See the help center.
- High-volume sellers give Selby the details the INFORM Consumers Act requires.
- You’re responsible for your taxes. Stripe sends sellers tax forms where the law requires them.
[For Selby’s lawyer: sales tax, and Selby’s duties as a marketplace facilitator.]
Buying
At checkout, Selby holds the price on your card, and charges it when the seller buys the shipping label, or at a pickup’s handoff. Check what you receive in time, and report a problem on the order’s page. See buyer protection.
Shipping and meetups
Ship with Selby’s prepaid label. At a meetup, the buyer’s code completes the sale: hand the item over once they’ve checked it.
Payouts
Sellers are paid through Stripe, on the schedule in the help center. A payout can wait while a problem report or a dispute is open, or after a change to your account’s security.
Messages and conduct
- Keep your conversations and payments on Selby. Don’t ask anyone to pay, or to talk, outside it.
- Selby scans messages, and its AI reviews some conversations, to stop scams. See the privacy policy.
- No harassment, scams, counterfeits, or anything illegal.
- If you break these terms, Selby may warn you, limit your account, suspend it, or ban you. You can appeal from your account’s standing.
What you post
Your listings and photos stay yours. You let Selby show, copy and adapt them to run Selby. Your story’s photo is licensed to Selby as your listing photos are. See copyright and intimate images.
[For Selby’s lawyer: the exact terms of the license.]
Disputes and chargebacks
Selby answers a bank’s dispute for you, and who pays is in the disputes policy.
Ending your account
You can delete your account; Selby keeps the records it must (see the privacy policy). Selby may close an account that breaks these terms.
The law
[For Selby’s lawyer: disclaimers, limits of liability, indemnity, the governing law, and how disputes with Selby are resolved.]
Changes
When these terms change, the version above changes with them.
[For Selby’s lawyer: how members are told of a change, and accept it.]
