Selby

Copyright

If a listing on Selby uses your photos, words or other work without permission, tell Selby’s copyright agent, and we’ll take it down.

Under the Digital Millennium Copyright Act (17 U.S.C. § 512), a notice includes:

  • your signature (typing your full name works);
  • the copyrighted work you say is infringed;
  • the Selby listings you say infringe it, with their links;
  • your name, mailing address, phone number and email;
  • a statement that you believe in good faith the use isn’t authorized by the copyright owner, its agent or the law;
  • a statement that the notice is accurate and, under penalty of perjury, that you’re the owner or authorized to act for the owner.

Send a copyright notice, or send one to Selby’s copyright agent.

If your listing was taken down

We’ll tell you, and show you who sent the notice and about what on your account’s copyright page. If you believe it was taken down by mistake or misidentification, you can send a counter-notice from that page (or to Selby’s copyright agent). It includes:

  • your signature (typing your full name works);
  • the listing that was taken down, with its link;
  • a statement, under penalty of perjury, that you believe in good faith it was taken down by mistake or misidentification;
  • your name, address and phone number, a statement that you consent to the jurisdiction of the federal district court for your address (or, outside the United States, any judicial district where Selby may be found), and that you’ll accept service of process from the person who sent the notice, or their agent.

We’ll send a copy to the person who sent the notice. Unless they tell us they’ve gone to court, we’ll put your listing back 10 to 14 business days after we get your counter-notice.

Repeat infringers

Each notice Selby upholds is a copyright strike on the seller’s account. Three copyright strikes in 12 months end the account. A strike Selby sets aside (a notice withdrawn, or a listing put back after a counter-notice) doesn’t count.

A notice or counter-notice that knowingly misrepresents something can make its sender liable for damages (17 U.S.C. § 512(f)).
